This Legal Notice has been prepared with respect and compliance with the provisions contained in REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of April 27, 2016 regarding the protection of natural persons with regard to the treatment of personal data and the free circulation of these data and the Organic Law 3/2018 on the Protection of Personal Data and guarantee of digital rights, the Organic Law 15/1999, of December 13, on the Protection of Personal Data and in the Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce.
1. Ownership of the website
1.1. The website www.inndih.com is owned by the Instituto Tecnológico de Informática (hereinafter, ITI) with CIF G96278734 and address at Camino de Vera s/n; CPI- Edif. 8G Acceso B – 46022 Valencia (Spain), registered in the National Registry of Associations, with number 133,810 and in the Provincial Registry of Associations, with number 6,521.
1.2. The use of the Website attributes the condition of the user of the Website and implies the full and unreserved acceptance of each and every one of the provisions included in this Legal Notice in the version published by ITI at the same time that the user access the Website.
1.3. ITI reserves the right to modify this legal notice, being the user’s obligation to periodically review the conditions that are updated by ITI.
2. Object of the website
The purpose of the Website is to disseminate the activities carried out by ITIITI, as well as the publication of events and news from third parties or related entities.
3. Use of the website
3.1. Access to the website is aimed at people over 18 years of age.
3.2. To make use of the Services, minors must obtain prior permission from their parent(s), guardian(s) or legal representative(s), who will be considered responsible/ s of all the acts carried out by the minors in their care.
3.3 Access to the private part of the Website is exclusively directed to previously authorized ITI and external personnel who have been provided with a user identifier and a password to access it.
3.4 Users with permission to access the private part are solely responsible for keeping and guarding their password.
3.5 Obligation to make correct use of the Website.
3.5.1. The user agrees to use the Website in accordance with the law, this Legal Notice and other notices, regulations of use and instructions made known to them, as well as with morality and generally accepted good customs and public order.
3.5.2. To this end, the user will refrain from using any of the Services for illicit purposes or effects, prohibited in this Legal Notice, harmful to the rights and interests of third parties or entities, harmful to their personal and/or professional image, or that in any way may damage, disable, overload, deteriorate or prevent the normal use of the Services, computer equipment or documents, files and all kinds of content stored in any computer equipment (hacking) of ITIITI, of other users or any other user of the Internet (hardware and software).
3.5.3. In particular, and merely indicative and not exhaustive, the user undertakes not to transmit, disseminate or make available to third parties or entities information, data, content, messages, graphics, drawings, sound and/or image files, photographs, recordings, software and, in general, any kind of material that:
(a) in any way is contrary to, disregards or violates the fundamental rights and public freedoms recognized constitutionally, in international treaties and in the rest of the legislation;
(b) induces, incites or promotes criminal, denigratory, defamatory, infamous, violent actions or, in general, contrary to the law, morality and generally accepted good customs or public order;
(c) induces, incites or promotes discriminatory actions, attitudes or thoughts based on sex, race, religion, beliefs, age or condition;
(d) incorporates, makes available or allows access to products, elements, messages and/or services that are criminal, violent, offensive, harmful, degrading or, in general, contrary to the law, morality and generally accepted good customs or to public order;
(e) induces or may induce an unacceptable state of anxiety or fear;
(f) induces or incites to engage in dangerous, risky or harmful practices for health and mental balance;
(g) is false, ambiguous, inaccurate, exaggerated or extemporaneous, in a way that leads or may lead to error about its object or about the intentions or purposes of the communicating person;6.1 In the provisions of this notice, as well as in the interpretation and resolution of conflicts that may arise between the user and ITI, Spanish legislation will apply.
(h) is protected by any intellectual or industrial property rights belonging to third parties or entities. without the user having previously obtained from his/her holder(s) the authorization
(i) violates the business secrets of third parties or entities;
(j) is contrary to the right to honor, personal and family privacy or the image of people;
(k) in any way undermines the credit of ITI or third parties or entities;
(l) violates the regulations on secrecy of communications;
(m) constitutes, where appropriate, illicit, misleading or unfair advertising and, in general, that constitutes unfair competition;
(n) incorporates viruses or other physical or electronic elements that may damage or prevent the normal functioning of the network, system or computer equipment (hardware and software) of ITI or third parties or entities, or that may damage electronic documents and files stored on said computer equipment;
(o) causes, due to its characteristics (such as format, extension, etc.), difficulties in the normal functioning of the Service;
3.6 ITI does not assume any responsibility for the external links that, where appropriate, may be included on the Website, since it does not have any type of control over them, for which the user accesses the content under their sole responsibility and in the conditions of use that govern them.
3.7. ITI does not assume any responsibility derived from the contents uploaded by third parties or entities on this website without their consent or knowledge, or for those whose illegality is unknown for not having been previously communicated through a reliable and receptive channel.
4. Protection of personal data
4.1. The personal data provided by the user will be part of a file owned by ITI, in order to manage the relationship as a user of the Website, resolve their doubts and queries.
4.2. Likewise, you will be sent information regarding our activity, such as news, promotions, discounts, which may be of interest to you.
4.3. ITI states that all information will be treated confidentially, as well as the effective implementation of all security measures that guarantee the security of your personal data.
4.4. The user may at any time exercise their rights of access, rectification, opposition or cancellation, for which they must send a letter or email stating the right they wish to exercise, attaching a copy of the National Identity Document or similar documentation to the address above indicated or to the email dpo@iti.es.
4.5 Cookies
4.5.1. In order to streamline the service offered, ITI will use “cookies” to offer you a better and more personalized service. This “cookie” is installed when the browsing session begins on any of the ITI websites. If the user does not want a “cookie” to be installed on his hard drive, he must configure his browser not to receive them, using the one recommended by his browser for this procedure, or delete it directly on his computer.
4.5.2. In case of elimination of “cookies”, the speed and quality in the operation of ITI services may decrease.
ITI will save your typical navigation route to adapt our services as much as possible to your preferences. The user expressly consents to the use of “cookies” by ITI, without it being necessary to request their consent again each time they enter our website.
5. Intellectual and industrial property
5.1. ITI is the owner of the intellectual and industrial property rights, or has obtained the corresponding authorizations or licenses for their exploitation, associated with the domain name, the trademarks and distinctive signs, the application, the information, the computer programs and the rest of the works and inventions contained in or related to this website and the technology associated with it.
5.2. The contents of this website, including designs, applications, text, images and source code (“Content”), are protected by intellectual and industrial property rights, except for the contents of third parties or entities that appear on it.
5.3. The contents of this website may not be used, reproduced, copied, transformed or transmitted in any way without the prior, written and explicit permission of ITI.
6. Applicable legislation and submission to jurisdiction
6.1 In the provisions of this notice, as well as in the interpretation and resolution of conflicts that may arise between the user and ITI, Spanish legislation will apply.
6.2 Both the user and ITI, expressly waiving any jurisdiction, which, according to law, may correspond to them, submit to the jurisdiction of the Courts and Tribunals of the city of Valencia.
